These Terms and Conditions of Sale (“Terms”) govern purchases made through the Midnight Secrets online store (the “Website”), operated by GALLEON, trading as Midnight Secrets.
These Terms apply to consumers purchasing products for personal and non-commercial use.
By placing an order through the Website, the customer confirms that they have read and accepted these Terms before completing their purchase.
Midnight Secrets may update these Terms from time to time. The Terms applicable to an order are those in force at the time the order is placed.
Nothing in these Terms excludes or restricts mandatory rights available to consumers under applicable law.

Midnight Secrets offers products designed primarily for couples, intimacy, comfort and wellbeing, including the Midnight Secrets Intimacy Pillow and related products and accessories.
The essential characteristics of each product are described on the relevant product page.
We make reasonable efforts to ensure that product descriptions, photographs, dimensions and other information are accurate.
However, photographs and visual representations are provided for illustrative purposes. Minor variations in colour, texture, appearance or dimensions may occur due to manufacturing processes, photography, lighting or screen settings.
Products are offered subject to availability.
If a product becomes unavailable after an order has been placed, the customer will be informed and an appropriate refund will be issued where necessary.
Prices displayed on the Website for customers in the United Kingdom are generally shown in Pounds Sterling (£ / GBP).
The price applicable to an order is the price displayed and confirmed at checkout when the order is placed.
GALLEON currently benefits from the French VAT exemption regime under Article 293 B of the French General Tax Code.
Any delivery charges or other applicable costs payable by the customer will be displayed before the order is confirmed.
Standard delivery to eligible UK destinations is currently offered free of charge, unless otherwise indicated during checkout.
Midnight Secrets reserves the right to change its prices at any time. Any such changes will not affect orders already accepted.
Customers select the products they wish to purchase, add them to their basket and follow the checkout process.
Before completing the order, customers have the opportunity to review the products selected, delivery information and total price.
An order is considered submitted once the customer completes the checkout process and payment is successfully authorised.

Midnight Secrets uses discreet external packaging wherever reasonably possible due to the nature of the products sold.
Nothing in this section limits any mandatory rights customers may have where an order is not delivered within the agreed or legally applicable timeframe.
UK consumers purchasing online generally benefit from statutory cancellation rights under applicable consumer legislation.
However, specific exceptions can apply to certain products supplied sealed for health protection or hygiene reasons once they have been unsealed after delivery.
Because Midnight Secrets sells products intended for intimate use, certain products may fall within applicable hygiene-related exceptions once opened or used.
Accordingly, where permitted by law, products that have been unsealed and used for intimate purposes cannot be returned simply because the customer has changed their mind.
This restriction does not affect the customer’s statutory rights where a product is faulty, damaged, misdescribed or otherwise does not conform to the contract.

In addition to applicable statutory rights, Midnight Secrets provides a commercial 30-Night Satisfaction Guarantee.
Customers may submit an eligible return request within 30 days of receiving their order.
The 30-Night Satisfaction Guarantee does not mean that an intimacy product can be used for 30 nights and subsequently returned.
For hygiene and health protection reasons, products that have been used for intimate purposes may not qualify for our voluntary satisfaction guarantee.
To qualify for a return under the commercial guarantee, products must comply with the requirements contained in our Returns & Refund Policy.

This commercial guarantee is provided in addition to statutory consumer rights and does not replace or restrict them.
Customers retain their statutory rights regarding products that are faulty, damaged, misdescribed or otherwise fail to conform to the contract.
Where applicable, remedies may include repair, replacement, price reduction or refund in accordance with applicable consumer legislation.
The hygiene restrictions applicable to voluntary change-of-mind returns do not remove statutory rights relating to faulty or non-conforming goods.

Customers will then receive the appropriate return instructions where the return is accepted.
Products should not be returned to the business address shown in Article 2 unless Midnight Secrets specifically instructs the customer to do so.
The appropriate return address may vary depending on the order and fulfilment location.
Unauthorised returns sent to an incorrect address may result in processing delays.
Return postage costs are normally the responsibility of the customer for eligible change-of-mind returns, unless otherwise stated or required by applicable law.
Where a product is confirmed as faulty, damaged or incorrectly supplied, different arrangements may apply.

Where a return is accepted and approved following inspection, the refund will normally be issued to the original payment method.
Refund processing times may vary depending on the customer’s bank or payment provider.
Once approved by Midnight Secrets, refunds generally appear within approximately 5–14 business days, depending on the payment provider.
Nothing in this provision extends any statutory refund deadline where a shorter deadline is required by applicable law.

In particular, customers residing in the United Kingdom retain any mandatory consumer protections applicable to them under UK law where those protections apply to the transaction.
Nothing in these Terms is intended to deprive a consumer of mandatory protections available under applicable law.
In the event of a dispute, the parties are encouraged to seek an amicable resolution before commencing legal proceedings.
Where a dispute cannot be resolved amicably, jurisdiction will be determined in accordance with applicable law.
